The cost for a divorce varies depending on the complexity of your matter. Matters involving property or parenting disputes can cost significantly more than a straight forward divorce. At Eminent Lawyers, we’ll give you a clear, upfront estimate at your free consultation so there are no surprises. 

Before you can apply, you and your spouse must have been separated for at least 12 months. Once your application is filed, an uncontested divorce usually takes around 3 to 4 months from filing to finalisation, depending on court scheduling. Contested matters or those involving unresolved property or parenting issues, can take considerably longer.

A parenting plan is a flexible, written agreement between parents that isn’t legally enforceable through the courts. A consent order is a formal agreement approved by the court that has the same legal force as a court judgment –  this means it can be enforced if one party doesn’t comply. Consent orders can also cover property settlement, not just parenting arrangements.

A lawyer isn’t legally required to create a parenting plan, but it’s strongly recommended – especially where there’s disagreement, a history of conflict or for safety concerns. A parenting plan is a written agreement and isn’t legally enforceable on its own, so getting legal advice helps ensure it properly protects your children’s interests and can be converted into legally binding consent orders if needed.
